Family Law

McManis Faulkner takes pride in its family law group. Our attorneys have extensive experience representing both petitioners and respondents, husbands and wives, in the dissolution of marriage, and our cases involve such diverse issues as child and spousal support; custody and visitation; and division of property involving residence, real and vacation property, stock options, employment benefits, pensions, and stock and bank accounts. Our practice also involves the set aside issues of marital settlements and prenuptials, as well as the rights of same sex couples. Our family law attorneys also have experience representing young and teenage children as well as minor children as appointed by the court.

MF lawyers serve as consulting attorneys for parties who are mediating their own cases. Rather than actually represent the parties in these matters, we consult as they negotiate their own cases with the assistance of a skilled mediator, both for property and custody issues. MF works closely with professional consultants, forensic accountants and experts to guide our clients through the mediation and evaluation processes.

The firm also works closely with private judges, often jointly retaining private judges with opposing counsel, as well as representing clients before the Superior Court in Santa Clara County and other Bay Area venues.

At MF, we have a strong group of attorneys with expertise in a number of areas, including civil law. This strong background in civil litigation provides extensive experience with discovery disputes, as well as law and motion practice from that area. MF attorneys have the ability to bring a breadth of knowledge and understanding of business and torts and other crossover issues in family law cases. Approximately 98% of our cases settle and 2% go to trial, and our results are generally excellent. We take pride in our command of detail and ability to carry out complex cases as a result of the team we have assembled.
