Representative Employment Cases
  • MF represented a local card club and obtained a dismissal of an age discrimination case on summary judgment. The judgment of dismissal was affirmed on appeal.
  • MF lawyers represented a 54-year old, African-American woman in a discrimination case and labor arbitration. After 28 years of faithful service to the Santa Clara Superior Court ("Court"), she was fired for alleged, "timekeeping fraud," and replaced with a younger, less qualified Caucasian woman.  After binding arbitration conducted pursuant to Plaintiff's union agreement, the arbitrator determined that the Court did not have just cause to fire Plaintiff and ordered that she be reinstated.  This decision, that the Court did not have cause to terminate Plaintiff, along with strong evidence that the Court had treated other employees outside of Plaintiff's protected classes leniently when disciplining them, demonstrated that Defendants' purported reasons for firing Plaintiff were unsupported by the evidence and were pretextual.  McManis Faulkner was able to settle the case on very favorable terms. 
  • MF represented the Chief of the San Jose Fire Department following his termination by the City Manager. The chief obtained a jury verdict in excess of $600,000, following his trial for wrongful discharge.
