Technical Equities: Special Master


In 1986, a San Jose, California, investment firm, Technical Equities (T.E.), described by many as nothing but an elaborate pyramid scheme, went bankrupt. Not surprisingly, investors and others filed a multitude of lawsuits against the investment firm and its founder, as well as the accounting, brokerage and law firms that had given T.E. its air of respectability.

Coordinated as one mammoth case in the state court, T.E. became known as the largest securities fraud case in the history of California and the most complicated ever for the Santa Clara County Superior Court. Judge Conrad Rushing, assigned to the case, quickly set it for trial. The large number of attorneys and defendants required the construction of a special facility at the Santa Clara convention center. All those involved forecasted a one-year trial.

James McManis entered the case when Judge Rushing asked him to serve as Special Master. Supervising discovery proceedings, case management conferences, and a marathon of settlement conferences, McManis eventually resolved over 800 cases that led to settlements in excess of 100 million dollars, saving the litigants and the court countless hours and dollars. These also included T.E. cases filed in the United States District Court for the Northern District of California.
